Sedayedarya and you agree to resolve disputes through confidential, binding arbitration, waiving the right to court litigation. “Dispute” is broadly defined to cover all claims between you and Sedayedarya, including billing issues and service-related matters. Exceptions apply as required by local law.
2. Domestic disputes with Afghan nationals will be resolved by the Afghan Center for Dispute Resolution (ACDR) under Afghan arbitration laws in Kabul. International disputes will be resolved under Dubai International Arbitration Center (DIAC) rules in Dubai, UAE.
3. Before arbitration, parties must exchange written Notices of Dispute. Unresolved disputes after 45 days may proceed to arbitration.
4. Arbitration rules include individual resolution (no class actions) and limited attorneys’ fees unless frivolous claims are brought.
5. Arbitration fees follow procedural rules.
6. Arbitrators will issue reasoned decisions after good-faith exchanges of information.
7. Attorneys’ fees are generally borne individually unless otherwise provided by law or ordered.
8. Declaratory or injunctive relief applies only to individual claims unless Sedayedarya consents otherwise.
9. Arbitration proceedings are confidential, with limited exceptions for legal or enforcement purposes.
10. Invalid provisions do not nullify the agreement unless specific exceptions are rendered unenforceable.

Indemnity

You agree to indemnify and defend Sedayedarya, its affiliates, and their agents against claims, damages, or costs arising from your website use, violations of these Terms, or infringement of others’ rights.Sedayedarya reserves the right to assume exclusive control of such matters, and you must cooperate fully.

Governing Law

These Terms are governed by Afghan law. Except for disputes resolved through arbitration, parties agree to exclusive jurisdiction in Kabul courts. You waive the right to alternative arbitration through Huqooq for litigation.
